Terms, privacy and your responsibilities

When you create an account you agree to two documents: the License Terms and the Privacy Policy. This page says where they are and summarises what they ask of you. It is a guide to reading them, not a replacement: where this page and the documents differ, the documents are right. Whoever signs the choir up should read both.

Both languages are published, and the terms say the two have equal force. If you are in Québec, the French version is shown to you first, and you may accept either.

How you agree​

The first time you sign in to the account portal, before your account is created, a page headed One last thing asks you to tick a box to agree to the terms. Nobody has an account who has not agreed. See Sign in to your account.

The terms in plain words​

The License Terms have two parts. Part B covers the hosted service, and is the one this section summarises. Quotations are from the terms as last updated on October 9, 2026.

Your content"You keep ownership of your content." You give us a licence to host and show it only as needed to provide the service, and you must have the rights to everything you publish.
Acceptable useNo content that is unlawful, infringing, defamatory, hateful, sexually exploitative, or that harasses or threatens anyone; no malware or phishing; no interfering with the service or other customers; no large media or video in ways your plan does not support; no reselling the service without our written permission. Your site is hosted on Cloudflare, and Cloudflare's terms apply to it as if you were its customer.
Your accountGive accurate information, keep your sign-in secure, and you answer for everything done under your account, including by people you invite.
EmailWe send through Amazon Simple Email Service. You must follow its rules and anti-spam law, including Canada's Anti-Spam Legislation (CASL): send only to people who have consented, and keep records of that; do not use bought, rented or scraped lists; identify yourself accurately and include a working unsubscribe; and keep bounce and complaint rates within our published limits. We may pause or limit your sending without notice if it puts our sending reputation at risk. See How your site sends email.
The Free planWebsite features only, with no warranty, and "we may change, limit, suspend or end the Free plan ... at any time and for any reason", with 14 days' notice where practicable. See If your site says it is paused.
Billing and renewalPaid plans are billed in advance, monthly or yearly, and renew automatically until cancelled. Prices are in Canadian dollars in Canada and US dollars elsewhere, without taxes. We give at least 30 days' notice before a price change reaches your next renewal. Fees are not refundable except as the law requires or as the terms provide. Late paymentA 30-day grace period with your paid features still working, then conversion to the Free plan. Paid-plan data is kept for at least 90 days, and paying or subscribing again within that time restores it.
Tickets and giftsThey are paid through your own Stripe account. You are the seller or recipient and the merchant of record, responsible for your refund policy, disputes, taxes and any receipts the law requires. We do not hold or transfer the money. See Take card payments: connect Stripe.
Personal informationYou control your members', donors', buyers' and visitors' information. You need a lawful basis and any required consent to collect it, and you must publish your own privacy policy. We handle it only to provide the service.
Young membersThe Privacy Policy says that the administrators who add young members are responsible for the laws on minors' information where they live, including parental consent. In Québec, for example, a parent's or tutor's consent is required to collect information about a child under 14.
Suspension and closingWe may suspend or end an account, or remove content, for a breach, for legal or security risk, or if Cloudflare, Amazon or Stripe requires it, giving notice and a chance to fix it where practicable. You may close your account at any time. See Your data.
Changes to the termsAt least 30 days' notice by email or in the service. If you do not accept the change, you may cancel before it takes effect and receive a pro-rated refund of prepaid fees.
Special offersExtra terms shown with an offer, such as founder pricing or a setup package, form part of the agreement. See Have us set up your site.
Governing lawThe laws of Ontario, Canada. The courts of Orillia, Ontario have exclusive jurisdiction, except where consumer protection law lets you sue elsewhere.

Your choir's own responsibilities​

Taken together, the documents leave the choir responsible for:

  • its members', donors' and ticket buyers' personal information, and publishing a privacy policy of its own;
  • the consent of the people it emails, and honouring unsubscribes;
  • its sales and gifts: refunds, receipts and taxes;
  • the rights to everything on its site.

If you run the software yourself​

Part A of the same document covers the self-hosted software instead: licence keys, the Community and Standard editions, the "Powered by Choir Master CMS" link, and what you may and may not do with the code. It does not apply to a hosted site. See Community and Standard editions.

Where the documents and the product differ​

  • The Privacy Policy lists "password (stored only in hashed form)" under account information. The account portal and the admin panel do not use passwords: you sign in with an emailed link.
